(Lac-Megantic) accused of criminal negligence causing death after the tragedy of Lac-Mégantic, the engineer of the locomotive of the Montreal, Maine and Atlantic Railway (MMA) Thomas Harding is trying to quash criminal proceedings against him.
The latter was charged jointly with Jean Demaître Richard Labrie and MMA May 2014 regarding rail tragedy that made 47 dead and destroyed the city of Lac-Mégantic, on 6 July 2013.
Counsel for Mr. Thomas Walsh defense argued a motion for disclosure of evidence in order to get information to argue subsequently the request for stay of proceedings before the Gaétan Dumas judge of the Superior Court Palace justice Lac-Mégantic.
“Taken together, four or five elements of the attitude of the crown reflect an attitude of wanting to win at all costs. For three years, this attitude of the Crown guarantee to the accused a trial that is not fair, “said Mr. Walsh.
“It is my opinion that it was malicious and degrading.”
Walsh tries to get me from pursuing the reasons why his client brought in handcuffs to court in Lac-Mégantic. Mr. Walsh described the exchanges with the prosecution of the collaborative efforts made to prevent his client, a man with no criminal record, arrest by the intervention group at his home in Farham, to have handcuffed, taken to jail , interviewed with 47 photos of the victims then brought before the media for his appearance as the “staging” of May 24, 2014.
“It is my opinion that it was malicious and degrading. The crown has to explain why she had that attitude to bring my client before the Court (…) Did the judge who issued arrest mandate knew my client had offered to come to court with his lawyer on a date fixed in advance? If they are able to mislead and conceal this information to judge upon the issue of the arrest warrant, they are able to do anything, “Walsh asked me.
The defense lawyer also wants the names of those who took part in the decision regarding the arrest, but also to file a preferred indictment that resulted in the stage of preliminary investigation will not occur.
